3D Model Club Website End User License Agreement, License Grant from Vendor to 3D Model Club, License Agreement between Vendor and Member, and General Terms.

DEFINITIONS:

1. "Content" refers to any material published at 3D Model Club including but not limited to wire files, models, textures, plug-ins, collections, tutorials, frequently asked questions, images, and software.
2. "Member" refers to any person who creates a user account at 3D Model Club.
3. "3D Model Club" refers to 3D Model Club.
4. "Royalty Free" refers to a one-time usage fee as distinguished from a recurring rights fee.
5. "Affiliate" means an entity with which the 3D Model Club Corporation has entered into a sales affiliate relationship.
6. "Membership Services" refers to transmission and/or purchase of content to and from 3D Model Club via the 3D Model Club Website, or any approved web portal either currently in existence or in the future.
7. "For Sale" includes all content that requires a purchase of license rights, as distinguished from content available for free download.
8. "Valid Sale" refers to a sale of license rights in content, or other property via 3D Model Club.

3D MODEL CLUB WEBSITE END USER LICENSE AGREEMENT YOU SHOULD CAREFULLY READ THE FOLLOWING TERMS AND CONDITIONS BEFORE USING THE 3D MODEL CLUB WEBSITE ANY ACCOMPANYING DOCUMENTATION, AND THE TERMS AND CONDITIONS OF THE 3D MODEL CLUB MEMBERSHIP SERVICES. YOUR USE 3D MODEL CLUB MEMBERSHIP SERVICES MEANS THAT YOU ACCEPT THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS YOU SHOULD NOT USE THE 3D MODEL CLUB MEMBERSHIP SERVICES. BY INSTALLING, DOWNLOADING, OR OTHERWISE USING 3D MODEL CLUB MEMBERSHIP SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS AND CONDITIONS, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU SHOULD NOT USE 3D MODEL CLUB MEMBERSHIP SERVICES.  LICENSE AGREEMENT BETWEEN VENDOR AND MEMBER

License Grant:

For any transmission of content from 3D Model Club to a Member, whether the transmission was the result of a license or free download, the following terms apply unless more restrictive terms are specified in the text description of the content:

• Ownership. Unless explicitly provided for by a separate agreement, 3D Model Club retains, copyright in content purchased or downloaded by any member via 3D Model Club.
• Valid License. Any license rights relating to content for sale via 3D Model Club are contingent upon the transfer of money from the member to the 3D Model Club. All license rights terminate immediately and without notice if a sale is reversed for any reason.
• Rights Granted. The Vendor grants to the member who either purchases license rights to content via a valid sale, or downloads freely available content submitted by the Vendor, a non-exclusive, non-transferable, worldwide, royalty-free license to: publicly perform, publicly display, and digitally perform said content.
• Rights Not Granted. Absent a written grant of rights greater than that contained in paragraph 3 above, all other rights or sub-divisions of rights generally included in copyright are excluded from this license.
• Resale. The resale or redistribution by the third party of any content obtained from 3D Model Club, whether for sale or freely available for download, whether part of a valid sale or not, is expressly prohibited.

• Can I redistribute to others models provided to me.

  No you cannot sell, rent, give away models created by us for your use. 3D Model Club owns the intellectual property rights for any work commissioned to us.  Digitized models cannot distributed to third parties in any media, including, CDs, DVDs uploaded to websites, FTP sites, transmitted in any electronic way without explicit permission from 3D Model Club.  This restriction applies to individuals, corporate organisations, government organisations, non-profit organisations, schools, hospitals, prisons etc.  You are allowed to use our models into any finished products you may create for your clients or your own collection.

  You cannot make a mold or other production device for mass production. You also cannot sell the electronic files, in part or included in another design or in any format,  or give them away for free.

• Returned Content. In the event a member returns any content, whether acquired by valid sale or freely available for download, all license rights granted herein terminate and the member must immediately destroy any and all copies contained on any type of media under the control or possession of the member.
• Agreement Subject to Change. 3D Model Club, Inc. reserves the right to change the terms of this agreement with or without notice at any time.

Returns Policy:

Due to the nature of the products that we sell, returns are not possible or exchangeable for other models. However if you have received models that are corrupt, unable to open or have some other flows, we will do everything we can to rectify the situation and send you new files.
